Data Environmental Science, LLC (hereby referred to as “the Company”)

Forms, tools, websites, and services hosted by the Company. (hereby referred to as “Company Services”)

These terms and conditions outline the rules and regulations for the use of the Company’s Company Services.

License

Unless otherwise stated, Data Environmental Science, LLC own the intellectual property rights for all material on Company Services and all services hosted by the Company.. All intellectual property rights are reserved. You may access these services for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Republish material hosted by the Company

• Sell, rent or sub-license material hosted by the Company

• Reproduce, duplicate or copy material hosted by the Company

• Redistribute content hosted by the Company

This Agreement shall begin on the date hereof.

To the extent permitted by applicable laws, Data Environmental Science, LLC shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments and Content on Company Services.

Without prior approval and written permission, you may not create frames around our Company Services that alter in any way the visual presentation or appearance of Company Services.

Indemnification

You agree to indemnify Data Environmental Science, LLC and its affiliates and hold Data Environmental Science, LLC harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Liability

Data Environmental Science, LLC is not liable for any damages that may occur to you as a result of use or misuse of our Company Services. To the maximum extent permitted by law, you understand and expressly agree that Data Environmental Science, LLC will not be liable to you under any theory of liability for any indirect, incidental, special, consequential, or exemplary damages that may be incurred by you, including any loss of data, whether or not Data Environmental Science, LLC or its representatives have been advised of or should have been aware of the possibility of any such losses arising.

Data Environmental Science, LLC reserves the right to edit, modify, and change this agreement at any time. Updates to this agreement will be posted under the relevant service’s terms and conditions. This agreement is an understanding between Data Environmental Science, LLC and the user, and this supersedes and replaces all prior agreements regarding the use of this app.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our Company Services. Nothing in this disclaimer will:

• limit or exclude our or your liability for death or personal injury;

• limit or exclude our or your liability for fraud or fraudulent misrepresentation;

• limit any of our or your liabilities in any way that is not permitted under applicable law; or

• exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.

To the maximum extent permitted by law, you understand and expressly agree that your use of any Company Services is at your sole risk and that the Company Services are provided "as is" and "as available" without warranty of any kind.

Your use of the Company Services and any material downloaded or otherwise obtained through the use of COmpany Services is at your own discretion and risk and you are solely responsible for any damage to your computer system or other device or loss of data that results from such use.

The Company further expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to, the implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.
