Data Environmental Science, LLC (hereinafter referred to as the “Company”)

The Company reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you.

Limitation of Liability

To the maximum extent permitted by applicable law, Data Environmental Science, LLC shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to your use of, inability to use, or reliance upon the Company Services.

This limitation includes, without limitation, damages for loss of profits, loss of revenue, loss of business opportunities, loss of goodwill, loss of data, business interruption, or other intangible losses, even if the Company has been advised of the possibility of such damages.

To the maximum extent permitted by law, the total aggregate liability of Data Environmental Science, LLC arising out of or relating to the Company Services shall not exceed one hundred U.S. dollars (US $100).

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Company Services are provided on an "AS IS" and "AS AVAILABLE" basis.

The Company expressly disclaims all warranties, representations, and conditions of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

• Merchantability;

• Fitness for a particular purpose;

• Non-infringement;

• Accuracy of information;

• Availability of services; and

• Freedom from errors, interruptions, or harmful components.

Your use of the Company Services and any materials downloaded or otherwise obtained through the Company Services is at your sole discretion and risk. You are solely responsible for any damage to your computer system, devices, software, or loss of data resulting from such use.

Exceptions

Nothing in these Terms shall:

• Limit or exclude liability for death or personal injury caused by negligence;

• Limit or exclude liability for fraud or fraudulent misrepresentation;

• Limit any liability in a manner not permitted by applicable law; or

• Exclude any liability that cannot be excluded under applicable law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Company Services shall be subject to the exclusive jurisdiction of the state and federal courts located within the State of Washington, unless otherwise required by applicable law.

Changes to These Terms

Data Environmental Science, LLC reserves the right to modify, amend, or replace these Terms at any time.

Updated versions will be posted through the applicable Company Services and will become effective upon posting unless otherwise stated. Continued use of the Company Services following the posting of changes constitutes acceptance of those changes.

Entire Agreement

These Terms constitute the entire agreement between you and Data Environmental Science, LLC regarding your use of the Company Services and supersede all prior or contemporaneous agreements, communications, and understandings relating to such use.

Product-specific terms, privacy policies, and service agreements are provided separately for each product or service operated by Data Environmental Science, LLC.
